Welcome to AnacapaPools.com. This website is owned and operated by Anacapa Pools. By accessing or using this website, submitting a form, or requesting information through the website, you agree to these Terms and Conditions.

Please do not use this website if you do not agree to these terms.

2. Website Information

The information on this website is provided for general informational and promotional purposes. We make reasonable efforts to keep the website accurate and current, but we do not guarantee that every description, price, service area, availability statement, or other item will always be complete or free from error.

Website content does not constitute a binding offer, service agreement, professional inspection, warranty, or guarantee.

The scope, schedule, price, and terms of any work will be determined through a separate written estimate, proposal, work order, maintenance agreement, or service contract.

If information on this website differs from a signed agreement between you and Anacapa Pools, the signed agreement will control.

3. Estimates and Quote Requests

Submitting a quote request, contact form, email, text message, or other inquiry does not create a customer relationship or require Anacapa Pools to perform services.

Any estimate provided through the website, by telephone, or before an on-site evaluation may be preliminary. Final pricing may depend on factors such as:

  • Pool or spa size and condition
  • Water condition and chemical requirements
  • Equipment condition
  • Frequency of service
  • Accessibility
  • Required repairs or replacement parts
  • Unusual debris, algae, contamination, or damage
  • Commercial or regulatory requirements
  • Other conditions discovered during inspection or service

An estimate becomes binding only when accepted in the manner stated in the applicable written proposal or service agreement.

4. Service Availability

Services are subject to scheduling, technician availability, location, weather, access conditions, equipment availability, and other practical limitations.

Submitting a request through this website does not guarantee:

  • Acceptance as a customer
  • Same-day or emergency service
  • A specific appointment time
  • Availability in every location
  • A specific result or repair outcome
  • That a pool or spa can remain open during service

We may decline or discontinue service where conditions are unsafe, unlawful, inaccessible, outside our service area, or outside the services we provide.

5. Customer Responsibilities

Customers are responsible for providing accurate contact, property, pool, spa, and equipment information.

Where service is scheduled, the customer may also be responsible for:

  • Providing safe and timely access to the property
  • Securing pets
  • Maintaining adequate water and electrical service
  • Disclosing known hazards or equipment problems
  • Following operating, safety, and chemical instructions
  • Preventing unauthorized persons from entering the work area
  • Obtaining any required approval from an owner, landlord, property manager, homeowners association, or other authorized party

Additional responsibilities may be stated in the applicable service agreement.

6. Pool and Spa Conditions

Pool and spa water conditions can change because of weather, temperature, use, landscaping, equipment performance, water supply, contamination, maintenance between visits, and other factors outside our control.

Statements about water quality, cleanliness, chemical balance, equipment operation, or regulatory compliance describe the condition observed or service performed at a particular time. They are not a promise that conditions will remain unchanged after service.

Customers should follow all safety instructions and should not use a pool or spa when the water, equipment, surroundings, or chemical condition appears unsafe.

7. Repairs, Parts, and Manufacturer Warranties

Repair recommendations may be based on the visible and testable condition of equipment at the time of inspection. Some problems cannot be identified until equipment is opened, operated, disassembled, or further tested.

Unless expressly stated in writing:

  • Repairs and replacement parts are not included in routine maintenance fees.
  • Additional work requires customer authorization.
  • Manufacturer warranties are provided by the applicable manufacturer and remain subject to the manufacturer’s terms.
  • Anacapa Pools does not control manufacturer warranty decisions, replacement schedules, or product availability.

Any labor warranty offered by Anacapa Pools will be described in the applicable written agreement or invoice.

8. Recurring Services and Cancellation

Recurring maintenance services may be governed by a separate service agreement. That agreement should state the service frequency, price, included services, billing schedule, cancellation procedure, and any other applicable terms.

These website Terms and Conditions do not replace the cancellation terms contained in a signed maintenance agreement.

Customers should review their individual agreement before canceling, pausing, or changing recurring service.

9. Electronic Communications

When you submit a form, provide your email address or telephone number, or otherwise contact us, you authorize Anacapa Pools to respond using the contact information you provided.

Communications may include appointment information, estimates, service updates, billing matters, requested follow-up, and other messages related to your inquiry or customer relationship.

You are responsible for ensuring that the information you provide is accurate and that you are authorized to use the supplied email address and telephone number.

Submitting an inquiry does not automatically enroll you in unrelated promotional text messages.

10. Acceptable Website Use

You may use this website only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to the website or its systems
  • Interfere with website operation or security
  • Submit false, fraudulent, threatening, or unlawful information

13. Website Disclaimer

This website is provided on an “as is” and “as available” basis.

To the extent permitted by law, Anacapa Pools disclaims warranties concerning the website, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not guarantee that:

  • The website will always be available
  • Website content will always be current or error-free
  • Forms or messages will always be delivered successfully
  • The website will be free from viruses or harmful components
  • Information obtained through the website will meet every user’s needs

Nothing in these terms excludes a warranty or right that cannot legally be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, Anacapa Pools will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use of, or inability to use, this website.

This includes losses caused by website interruptions, transmission errors, third-party links, reliance on general website information, unauthorized access, or harmful code.

These limitations apply only to website use. Liability related to paid pool services will be governed by the applicable service agreement and California law.

Nothing in these terms limits liability that cannot legally be limited or excluded.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Anacapa Pools and its owners, employees, contractors, and representatives from claims, losses, liabilities, and reasonable costs arising from:

  • Your unlawful or unauthorized use of the website
  • Information you knowingly submit falsely
  • Your violation of these Terms and Conditions
  • Your infringement of another person’s rights

This section does not require you to indemnify Anacapa Pools for conduct for which indemnification cannot lawfully be required.

16. Privacy

Information submitted through this website is handled according to our Privacy Policy.

The Privacy Policy should be reviewed together with these Terms and Conditions, particularly before submitting personal information through a contact or quote-request form.

17. Governing Law

These Terms and Conditions are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute concerning website use will be handled in a court with proper jurisdiction in Ventura County, California, unless applicable law requires another location or procedure.

18. Changes to These Terms

We may revise these Terms and Conditions from time to time.

The revised version will be posted on this page with an updated “Last Updated” date. Changes apply from the date they are posted and do not retroactively change the terms of a previously signed service agreement.

Continued use of the website after revised terms are posted means you accept the revised website terms.

19. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

20. No Waiver

A failure by Anacapa Pools to enforce a provision of these terms does not waive the right to enforce that provision later.

21. Entire Agreement for Website Use

These Terms and Conditions, together with the Privacy Policy and any other policies posted on this website, form the agreement between you and Anacapa Pools concerning your use of the website.

They do not replace a written estimate, work order, recurring maintenance agreement, repair authorization, invoice, or other service-related contract.
